The procedure for providing medical services to minors
(persons under 14 years of age):
According to Article 43 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Care" No. 2801-ХІІ dated November 19, 1992, medical intervention for patients under the age of 14 years (juvenile patients) is carried out with the consent of their legal representatives.
According to Art. 242 of the Civil Code of Ukraine No. 435-ІV dated January 16, 2003, parents (adoptive parents) are the legal representatives of their minor and minor children. The guardian is the legal representative of a minor and an individual recognized as incapacitated.
The appeal of an individual to receive a medical service involves entering into a contractual relationship. According to Art. 31 of the Civil Code of Ukraine, a minor has the partial civil capacity, and therefore such a person may not be fully aware of the consequences of transactions.
Therefore, the legal representative of a minor child must necessarily give consent to medical intervention for a minor child and give consent to placing an order for a medical service for a minor. In this case, when applying to the department of the diagnostic center of the father or mother of the child, you must have a birth certificate of the child and a passport, a guardian - a decision of the court or guardianship authority and guardianship on the appointment of a guardian and a passport.
The service of taking samples from the urogenital tract with disposable systems (service code: 6003) is not provided to minors.
The procedure for providing medical services to minors
(persons aged 14 to 18):
According to Article 39 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Care", a patient who has reached the age of majority has the right to receive reliable and complete information about his health, including familiarization with the relevant medical documents relating to his health.
Parents (adoptive parents), guardians, and trustees have the right to receive information about the state of health of the child or ward.
According to Article 43 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Care", informed consent by Article 39 of the Fundamentals of the patient is necessary for the application of methods of diagnosis, prevention, and treatment. Due to the fact that information about the state of health of the child has the right to receive his legal representatives and child, to issue a medical service at the diagnostic center, a minor must obtain the consent of both the child and his legal representative.
According to Art. 34 of the Civil Code of Ukraine, a minor person has an incomplete civil capacity and may not be fully aware of the consequences of transactions.
In this connection, in the event of a repeated appeal to the department of the diagnostic center of a minor and the presence of a passport card of this patient in the electronic database of the Synevo laboratory, provided that such a card does not require additional changes, this minor patient has the right to order services in the department of the diagnostic center for an amount not exceeding 4000 UAH.The service of taking samples from the urogenital tract with disposable systems (service code: 6003) is not provided to minors.
If an order for a service for a minor child was placed and paid for on the Synevo laboratory website at the following link: www.new.synevo.ua, it is considered that the legal representative of the child has consented to the medical intervention and processing of personal data of his child.In this case, the medical service issued and paid for on the website of the Synevo laboratory can be provided without the presence of the legal representative of the child.
However, since, in accordance with the requirements of the current legislation of Ukraine, it is necessary to obtain consent to medical intervention from both a minor child and his legal representative, when placing an online order at the diagnostic center department, it is necessary to additionally obtain the informed consent of the minor for medical intervention in writing.
The medical service "taking samples from the urogenital tract with disposable systems" (service code 6003) cannot be provided to a minor,except persons who were married, upon presentation of the latter's passports and marriage certificates.
